i don't really like TES that much (i only liked morrowind), but if you played fallout 1 & 2 and morrowind & oblivion and then play fallout 3 then you have to agree that fallout 3 feels like a true sequel to morrowind instead of fallout 2.

i'm not saying that fallout 3 is bad (it isn't), but it didn't feel like fallout, it felt like a futuristic TES.

i have played all of the above (except morrowind) and i can see what you mean in terms of how the game is played, but content wise i feel its very much fallout.

yes, the story and setting is all fallout, but the gameplay is TES.
and that's not what i want in fallout, i want fallout to stay fallout.
i do not want fallout to become a TES clone.

so my opinion is that it should go to interplay.

If they didn't do fallout 3 like it was it probably would have sucked or would not have been as successful because it wouldn't be a FPS and the fallout gameplay doesn't appeal very much to younger gamers

If ownership is legally in Bethesda's court, then Interplay is out of luck. Managing to lose your own franchise sucks ass. They can claim all they want, but as long as there's a binding agreement out there that says Bethesda has the rights to producing content pertaining to the Fallout universe, then tough ****.

Hypothetically, if Interplay somehow do get to go ahead with projectv13, will they be able to pull it off?

Bethesda bought the rights to Fallout. I admit that I liked the early Fallouts, and that I'm not one to like how big businesses bully smaller ones, but Interplay has messed up a lot, and Bethesda hasn't. Fallout 3 was a huge hit compared to the earlier ones, and so a Fallout MMO should be what most people expect it to be; similar to Fallout 3, and with that aim in mind, made by Bethesda.

I also believe that Interplay were quite misleading in how they sold the "Fallout Trilogy". It gives people the cover impression that it would include Fallout 1, 2, and 3. Not Fallout 1, 2, and Tactics.

Granted, anyone who buys it without reading the case to find out that it does not include Fallout 3 probably wasn't using common sense. But it still is misleading, and I think Interplay was well aware that what they were doing was misleading.

I always loved turn-based-strategy RPGs, but my personal ideal would be a Fallout MMO that is more like Fallout 3, but with the atmosphere and harsher story elements that were present in the older Fallouts.
For example, in the original Fallout universe there's an actual backstory to deathclaws. They were created by the government to replace soldiers in close combat, and are very intelligent. Some can even speak in Fallout Tactics and (I think, been awhile since I've played) Fallout 2.

Little things like that added a ton of depth the early Fallouts, depth which the earlier ones did not have. Anyways, I'm digressing from the topic. Point is, I think Bethesda should own the rights, but I like Interplay more as a company.

After all, Bethesda made the big hit Fallout 3, and Interplay didn't do what they were hired to.

Interplay has had the better part of the 00's to deliver on a new Fallout, but has failed. Bethesda came in, built a Fallout with their Oblivion engine, and released it to much success. They also iterated upon it with five successful add-on packs.

In a year Bethesda did more with Fallout than Interplay has in nearly a decade. I think that shows which company is better suited to handle the franchise. I wish Bethesda the best in securing the multiplayer rights and look forward to what they have planned for Fallout single-player in the future, as I've already invested six months of my life into Fallout 3 and cannot wait to invest even more into the sequels.

They both can't have it because...? It would be cool to see to different perspectives of the same universe coexisting at the same time and maybe if you set them at different places and then had them intertwine in certain spots it might make the player more immersed.

No reason why Interplay couldn't maintain the multiplayer rights while Bethesda maintains the single player rights, but Bethesda has plans for a multiplayer game, which is why we have this court case.
